1. Any work carried out by CrestData
I.T. Ltd (hereafter "CrestData") on the behalf of
you the client (including registration of domain names and
webspace), remains the property of CrestData until the account
is paid in full.
2. All new portfolio are subject to
a 25% non-refundable deposit. We offer favourable payment
terms on an interim or fixed basis for large or ongoing portfolio,
but all other accounts must be settled upon completion and/or
installation of the site/project. Acceptable payment methods
include cheque (made payable to Crestdata I.T. LTD), bacs
transfer or cash.
3. Whilst we do try to give an accurate
price for site builds, some things are outside our control,
including hosting costs and we cannot guarantee that some
prices will not be subject to change.
4. CrestData will invoice following
completion of the work requested of us. We do not however,
wait for the setting up of merchant accounts or credit card
handling services.
Intellectual Property
5. CrestData owns the rights to the
code/functionality of all work carried out on behalf of clients.
Such code may not be copied, sold or adapted for use elsewhere
except where indicated as public domain or attributed to individuals
outside of CrestData. We refer in particular to large database
driven websites which may not be replicated or sold without
the express permission of Crestdata.
This does not affect your statutory rights.
Ecommerce
6. If you are serious about selling
online, you will need to be right up to date with consumer
law. Information is available on current
legislation and your obligations
as a merchant. If you infringe consumer rights
you may have your site closed or face possible court action,
so please make sure you are familiar with legislation in this
area.
7. Whilst CrestData makes every attempt
to stay abreast of the law and how it relates to online shopping,
the onus is on you, the merchant to ensure that your website
complies with current legislation. Under no circumstance will
CrestData or any of its associates or directors be held liable
for changes in legislation during the lifetime of your shopping
facility. You also have to state a date by which time the
goods will have been delivered. The emphasis in consumer law
now, is very much on delivery times, and how and where goods
should be returned. In most cases, consumers have a 14 day
cooling off period which means they have the right to return
goods during this period if they so choose.
8. The Data
Protection Act 1998 contains current legislation
regarding storage and retrieval of data, including how this
effects email.

9. We cannot guarantee that you will
be accepted for credit card validation services. For any kind
of secure ecommerce you will need to obtain a merchant account
to process online credit card orders through to your bank
account - please see your bank for details of how you can
obtain one. This is subject to status.

constitute the sole agreement between Crestdata and you respecting
the subject matter hereof and fully supersede any and all
other agreements, either oral or in writing. You acknowledge
